1.1. Šios prekių pirkimo – pardavimo taisyklės (toliau – Taisyklės) yra Šalims privalomas teisinis dokumentas, kuris nustato Pirkėjo ir Pardavėjo teises, pareigas ir atsakomybę Pirkėjui įsigyjant prekes el. parduotuvėje.
1.2. Pardavėjas pasilieka teisę bet kuriuo metu pakeisti, taisyti ar papildyti taisykles, atsižvelgdamas į teisės aktų nustatytus reikalavimus. Pirkėjas informuojamas el. parduotuvės tinklalapyje. Pirkėjui apsiperkant el. parduotuvėje taikomos Taisyklės, galiojančios užsakymo pateikimo metu.
1.3. Pirkti el. parduotuvėje turi teisę:
1.3.1. veiksnūs fiziniai asmenys, t.y., asmenys sulaukę pilnametystės, kurių veiksnumas nėra apribotas teismo tvarka;
1.3.2. nepilnamečiai nuo 14 iki 18 metų amžiaus, tik turėdami tėvų arba rūpintojų sutikimą, išskyrus tuos atvejus, kai jie savarankiškai disponuoja savo pajamomis;
1.3.3. juridiniai asmenys;
1.3.4. visų aukščiau nurodytų asmenų įgaliotieji atstovai.
1.4. Pardavėjas, patvirtindamas taisykles, taip pat garantuoja, kad, remiantis taisyklių 1.3. punktu, Pirkėjas turi teisę pirkti prekes el. parduotuvėje.
1.5. Sutartis tarp Pirkėjo ir Pardavėjo laikoma sudaryta nuo to momento, kai Pirkėjas el. parduotuvėje suformavęs prekių krepšelį, nurodęs pristatymo adresą, pasirinkęs atsiskaitymo būdą ir susipažinęs su Pardavėjo taisyklėmis, paspaudžia mygtuką „Patvirtinti užsakymą“ (žr. 5 punktą „Prekių užsakymas, kainos, atsiskaitymo tvarka, terminai“).
1.6. Kiekviena sutartis, sudaryta tarp Pirkėjo ir Pardavėjo, yra saugoma el. parduotuvėje.
2.1. Pateikdamas užsakymą Pirkėjas sutinka, kad jo pateikti asmens duomenys būtų tvarkomi užsakymo vykdymo ir tikslais. Pirkėjas taip pat sutinka, kad Pirkėjo nurodytu el. pašto adresu būtų siunčiami informaciniai pranešimai kurie yra būtini prekių užsakymui įvykdyti.
2.2. Pardavėjas įsipareigoja neatskleisti Pirkėjo asmens duomenų tretiesiems asmenims, išskyrus kai to reikalauja kompetentinga Valstybės institucija LR įstatymų numatytais atvejais arba atskiru rašytiniu Pirkėjo sutikimu.
3.1. Pirkėjas turi teisę pirkti prekes el. parduotuvėje šių Taisyklių ir kitose šios el. parduotuvės informacijos skiltyse nustatyta tvarka.
3.2. Pirkėjas turi teisę atsisakyti prekių pirkimo – pardavimo sutarties su el. parduotuve, pranešdamas Pardavėjui apie tai raštu (el. paštu, nurodant pageidaujamą grąžinti prekę ir jos užsakymo numerį) ne vėliau kaip per 14 (keturiolika) darbo dienų nuo daikto pristatymo dienos, išskyrus atvejus, kai sutarties negalima atsisakyti pagal LR įstatymus (pvz., kai sutartis sudaryta dėl higienos prekių – patalynės reikmenų – pardavimo; žr. informaciją VšĮ „Vartotojų centras“ tinklalapyje http://www.vartotojucentras.lt/istatymas.php?id=1038, „Ne maisto prekių grąžinimo ir keitimo ypatumai“ 18 punktą.).
3.3. Taisyklių 3.2. punkte numatyta teise Pirkėjas gali pasinaudoti tik tuo atveju, jeigu prekė nebuvo sugadinta arba iš esmės nepasikeitė jos išvaizda, taip pat ji nebuvo naudojama.
3.4. Pirkėjas įsipareigoja sumokėti Pardavėjui sutartą sumą už užsakytas prekes, ir jas priimti.
3.5. Jeigu pasikeičia Pirkėjo registracijos formoje pateikti duomenys, Pirkėjas privalo nedelsdamas juos atnaujinti.
3.6. Pirkėjas įsipareigoja neperduoti tretiesiems asmenims savo prisijungimo duomenų. Jei Pirkėjas praranda prisijungimo duomenis, jis privalo nedelsiant informuoti apie tai Pardavėją skyriuje „Kontaktai“ nurodytomis susisiekimo priemonėmis.
3.7. Pirkėjas, naudodamasis el. parduotuve, sutinka su šiomis pirkimo - pardavimo Taisyklėmis ir įsipareigoja jų laikytis bei nepažeisti LR teisės aktų.
4.1. Pardavėjas įsipareigoja sudaryti visas sąlygas Pirkėjui tinkamai naudotis el. parduotuvės teikiamomis paslaugomis.
4.2. Jei Pirkėjas bando pakenkti Pardavėjo el. parduotuvės darbo stabilumui ir saugumui ar pažeidžia savo įsipareigojimus, Pardavėjas turi teisę nedelsiant ir be perspėjimo apriboti ar sustabdyti Pirkėjo galimybę naudotis el. parduotuve arba išskirtiniais atvejais panaikinti Pirkėjo registraciją.
4.3. Pardavėjas įsipareigoja gerbti Pirkėjo privatumo teisę į Pirkėjo priklausančią asmeninę informaciją, nurodytą el. parduotuvės registracijos formoje.
4.4. Pardavėjas įsipareigoja pristatyti Pirkėjo užsakytas prekes Pirkėjo nurodytu adresu.
5.1. El. parduotuvėje Pirkėjas gali pirkti visą parą, 7 dienas per savaitę.
5.2. Sutartis pradeda galioti nuo to momento, kai Pirkėjas paspaudžia mygtuką „Pirkti” o gavęs užsakymą Pardavėjas jį patvirtina – atsiunčia patvirtinimo laišką Pirkėjo nurodytu el. paštu.
5.3. Prekių kainos el. parduotuvėje ir suformuotame užsakyme nurodomos eurais, įskaitant PVM.
5.4. Pirkėjas atsiskaito už prekes vienu iš šių būdų:
5.4.1. Atsiskaitymas naudojantis el. bankininkyste
5.4.2. Bankiniais pavedimais iš savo banko
5.5. Tik gavus apmokėjimą už prekes pradedamas formuoti prekių siuntinys ir pradedamas skaičiuoti prekių pristatymo terminas.
6.Pirkėjo ir pardavėjo atsakomybė.
6.1. Pirkėjas yra visiškai atsakingas už Pirkėjo pateikiamų asmens duomenų teisingumą. Jei Pirkėjas nepateikia tikslių asmens duomenų registracijos formoje, Pardavėjas neatsako už dėl to atsiradusius padarinius ir įgyja teisę reikalauti iš Pirkėjo patirtų tiesioginių nuostolių atlyginimo.
6.2. Pirkėjas atsako už veiksmus, atliktus naudojantis šia (boksai.lt) el. parduotuve.
6.3. Užsiregistravęs Pirkėjas atsako už savo prisijungimo duomenų perdavimą tretiesiems asmenims. Jei el. parduotuvės teikiamomis paslaugomis naudojasi trečiasis asmuo, prisijungęs prie el. parduotuvės naudodamasis Pirkėjo prisijungimo duomenimis, Pardavėjas šį asmenį laikome Pirkėju.
6.4. Pardavėjas atleidžiamas nuo bet kokios atsakomybės tais atvejais, kai nuostoliai kyla dėl to, jog Pirkėjas, neatsižvelgdamas į Pardavėjo rekomendacijas ir Pirkėjo įsipareigojimus, nesusipažino su šiomis Taisyklėmis, nors tokia galimybė jam buvo suteikta.
6.5. Jei Pardavėjo el. parduotuvėje yra nuorodos į kitų įmonių, įstaigų, organizacijų ar asmenų el. tinklalapius, Pardavėjas nėra atsakingas už ten esančią informaciją ar vykdomą veiklą, tų tinklapių neprižiūri, nekontroliuoja ir toms įmonėms bei asmenims neatstovauja.
6.6. Atsiradus žalai, kaltoji Šalis atlygina kitai Šaliai tiesioginius nuostolius.
7.1. Pardavėjas www.boksai.lt savo nuožiūra gali inicijuoti el. parduotuvėje įvairias akcijas ir pasiūlymus.
7.2. Pardavėjas turi teisę vienašališkai, be atskiro įspėjimo, pakeisti akcijų sąlygas, taip pat jas panaikinti. Bet koks akcijų sąlygų ir tvarkos pakeitimas ar panaikinimas galioja tik į priekį, t.y. nuo jų atlikimo momento.
7.3. Pardavėjas visus pranešimus siunčia Pirkėjo registracijos formoje nurodytomis susisiekimo priemonėmis.
7.4. Pirkėjas visus pranešimus ir klausimus siunčia Pardavėjo el. parduotuvės skyriuje „Kontaktai“ nurodytais telefonais ir el. pašto adresais.
7.5. Pardavėjas neatsako jei Pirkėjas negauna siunčiamų informacinių ar patvirtinančių pranešimų dėl internetinio ryšio, elektroninio pašto paslaugų tiekėjų tinklų sutrikimų.
8.1. Šios prekių pirkimo – pardavimo Taisyklės sudarytos vadovaujantis LR įstatymais ir teisės aktais.
8.2. Visi nesutarimai, kilę dėl šių Taisyklių vykdymo, sprendžiami derybų būdu. Nepavykus susitarti, ginčai sprendžiami LR įstatymų nustatyta tvarka.
1.1. These Terms and Conditions of Purchase and Sale (hereinafter referred to as the Terms) are a legally binding document for the Parties, which establishes the rights, obligations and liability of the Buyer and the Seller when the Buyer purchases goods in the online store.
1.2. The Seller reserves the right to change, correct or supplement the Terms at any time, taking into account the requirements established by legal acts. The Buyer is informed on the online store website. When the Buyer purchases in the online store, the Terms in force at the time of placing the order apply.
1.3. The following have the right to purchase in the online store:
1.3.1. legally competent natural persons, i.e., persons who have reached the age of majority and whose legal capacity has not been restricted by a court order;
1.3.2. minors from 14 to 18 years of age, only with the consent of their parents or guardians, except in cases where they independently manage their income;
1.3.3. legal entities;
1.3.4. authorized representatives of all the above-mentioned persons.
1.4. By confirming the Terms, the Seller also guarantees that, based on clause 1.3 of the Terms, the Buyer has the right to purchase goods in the online store.
1.5. The contract between the Buyer and the Seller is considered concluded from the moment when the Buyer, having formed a shopping cart in the online store, specified the delivery address, selected the payment method and familiarized themselves with the Seller's Terms, presses the "Confirm Order" button (see clause 5 "Order of goods, prices, payment procedure, deadlines").
1.6. Each contract concluded between the Buyer and the Seller is stored in the online store.
2.1. By placing an order, the Buyer agrees that their personal data will be processed for the purpose of order fulfillment. The Buyer also agrees that informational messages necessary for order fulfillment will be sent to the email address provided by the Buyer.
2.2. The Seller undertakes not to disclose the Buyer's personal data to third parties, except when required by a competent State institution in cases provided for by the laws of the Republic of Lithuania or with separate written consent of the Buyer.
3.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms and the procedure established in other information sections of this online store.
3.2. The Buyer has the right to withdraw from the purchase and sale contract with the online store by notifying the Seller in writing (by email, indicating the desired item to be returned and its order number) no later than 14 (fourteen) business days from the date of delivery of the item, except in cases where the contract cannot be withdrawn according to the laws of the Republic of Lithuania (e.g., when the contract is concluded for the sale of hygiene products - bedding items; see information on the website of the Public Institution "Consumer Center" http://www.vartotojucentras.lt/istatymas.php?id=1038, "Peculiarities of return and exchange of non-food products" clause 18).
3.3. The Buyer may exercise the right provided for in clause 3.2 of the Terms only if the product has not been damaged or its appearance has not substantially changed, and it has not been used.
3.4. The Buyer undertakes to pay the Seller the agreed amount for the ordered goods and to accept them.
3.5. If the data provided in the Buyer's registration form changes, the Buyer must update it immediately.
3.6. The Buyer undertakes not to transfer their login credentials to third parties. If the Buyer loses their login credentials, they must immediately inform the Seller using the contact methods specified in the "Contacts" section.
3.7. By using the online store, the Buyer agrees to these Terms of Purchase and Sale and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania.
4.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store.
4.2. If the Buyer attempts to harm the stability and security of the Seller's online store or violates their obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer's ability to use the online store or, in exceptional cases, cancel the Buyer's registration.
4.3. The Seller undertakes to respect the Buyer's right to privacy regarding the Buyer's personal information specified in the online store registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5.1. The Buyer can purchase in the online store 24 hours a day, 7 days a week.
5.2. The contract comes into force from the moment when the Buyer presses the "Buy" button and the Seller, having received the order, confirms it - sends a confirmation letter to the Buyer's specified email.
5.3. Prices of goods in the online store and in the formed order are indicated in euros, including VAT.
5.4. The Buyer pays for goods in one of the following ways:
5.4.1. Payment using electronic banking
5.4.2. Bank transfers from their bank
5.5. Only after receiving payment for the goods, the shipment of goods is started and the delivery period of goods begins to be counted.
6.1. The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation from the Buyer for direct losses incurred.
6.2. The Buyer is responsible for actions performed using this (boksai.lt) online store.
6.3. A registered Buyer is responsible for transferring their login credentials to third parties. If a third party uses the services of the online store by logging into the online store using the Buyer's login credentials, the Seller considers this person to be the Buyer.
6.4. The Seller is released from any liability in cases where losses arise because the Buyer, disregarding the Seller's recommendations and the Buyer's obligations, did not familiarize themselves with these Terms, although such an opportunity was provided.
6.5. If the Seller's online store contains links to websites of other companies, institutions, organizations or persons, the Seller is not responsible for the information or activities there, does not supervise or control those websites and does not represent those companies and persons.
6.6. In the event of damage, the guilty Party compensates the other Party for direct losses.
7.1. The Seller www.boksai.lt may, at its discretion, initiate various promotions and offers in the online store.
7.2. The Seller has the right to unilaterally, without separate notice, change the terms of promotions, as well as cancel them. Any change or cancellation of the terms and procedure of promotions applies only prospectively, i.e., from the moment of their implementation.
7.3. The Seller sends all notifications using the contact methods specified in the Buyer's registration form.
7.4. The Buyer sends all notifications and questions to the phones and email addresses specified in the "Contacts" section of the Seller's online store.
7.5. The Seller is not responsible if the Buyer does not receive informational or confirmation messages due to internet connection or email service provider network disruptions.
8.1. These Terms of Purchase and Sale are drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
8.2. All disputes arising from the implementation of these Terms are resolved through negotiations. If no agreement is reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
